Terms and Conditions of the Affiliate Program AboutHelmets.com

Article 1: Definitions

1.1 AboutHelmets.com: the operator of the webshop AboutHelmets.com.

1.2 Affiliate: any natural or legal person of at least 18 years old who is invited via a personal invitation and has registered to participate in the affiliate program of AboutHelmets.com. Registration takes place via af.uppromote.com/abouthelmets and is manually approved by AboutHelmets.com.

1.3 Affiliate Program: the program through which Affiliates promote AboutHelmets.com products via a personal link in exchange for a commission.

1.4 Personal Link: a unique URL provided by AboutHelmets.com to the Affiliate to direct visitors to the webshop.

1.5 Commission: the amount received by the Affiliate for each successful sale made through the personal link.

Article 2: Admission and Participation

2.1 Participation in the affiliate program is exclusively open to Affiliates who have received a personal invitation from AboutHelmets.com and are at least 18 years of age.

2.2 Registration takes place via af.uppromote.com/abouthelmets.

2.3 AboutHelmets.com reserves the right to reject applications without stating a reason, especially if submitted without an invitation.

2.4 Registration and each realized sale are manually approved by AboutHelmets.com.

2.5 The cooperation is established for a period of 12 months, after which it can be automatically extended upon evaluation.

2.6 By signing up for the affiliate program, the Affiliate agrees to these Terms and Conditions. The Affiliate must explicitly confirm during registration that they have read and agree to the terms.

Article 3: Compensation and Payment

3.1 The Affiliate receives a commission of 5% per successful sale made through the personal link. The commission is calculated on the purchase amount excluding VAT and shipping costs.

3.2 Payment takes place once a month on a fixed day determined by AboutHelmets.com.

3.3 A waiting period of up to 30 days after the sale date applies before the commission is paid, to verify returns and cancellations.

3.4 In the event of cancellation or return of the order, the commission will be void.

3.5 Payment to individual affiliates (without a VAT number) is made as a gross amount without VAT.

3.6 Payment to business affiliates (with a valid VAT number) requires an invoice including VAT, which will be added to the commission amount.

Article 4: Technical Limitations and Liability

4.1 AboutHelmets.com is not liable for non-registration of sales if a customer uses a browser or setting that blocks tracking.

4.2 Affiliates cannot claim a commission if the sale is not registered for this reason.

4.3 The tracking cookie has a standard validity of 30 days. If the customer returns via the personal link within this period and makes a purchase, the Affiliate receives the commission.

4.4 AboutHelmets.com is not liable for incorrect use of promotional material by the Affiliate or misleading statements.

4.5 Affiliates are not allowed to present themselves as an agent, representative, or retailer of AboutHelmets.com.

4.6 The use of techniques such as cookie-dropping, misleading pop-ups, or displaying the AboutHelmets.com website within an iframe is not permitted.

4.7 The Affiliate Partner may not use the brand name KEP Italia in domain names or as a keyword in advertisements, such as in Google Ads.

4.8 The Affiliate Partner is responsible for complying with the General Data Protection Regulation (GDPR) and other relevant privacy legislation. The Affiliate Partner indemnifies AboutHelmets.com from claims or damages arising from non-compliance with this legislation.

Article 5: Use of Social Media Content

5.1 AboutHelmets.com reserves the right to use and share photos and videos created by the Affiliate for their social media related to AboutHelmets.com or its products.

Article 6: Prohibited Activities

6.1 It is not allowed to use spam or misleading promotional practices.

6.2 Affiliates may not use the personal link for their own purchases to receive commissions.

6.3 Promotion through inappropriate, offensive, or illegal websites is prohibited.

6.4 The use of pop-ups, cookie dropping, or iFrames to unlawfully obtain commissions is not allowed.

Article 7: Promotional Material

7.1 Upon request, Affiliates can receive promotional material (such as banners) to place on their website. The use of banners on social media is not allowed.

7.2 The use of promotional material is only permitted in combination with the personal link.

Article 8: Termination

8.1 AboutHelmets.com reserves the right to immediately terminate the participation of an Affiliate in the program if the terms are violated.

8.2 AboutHelmets.com may terminate the cooperation if the promotion by the Affiliate does not align with the desired profile of AboutHelmets.com.

8.3 AboutHelmets.com reserves the right to terminate the cooperation if the Affiliate does not realize any sale for a period of 6 months.

8.4 Affiliates are not allowed to present themselves as an agent, representative, or retailer of AboutHelmets.com.

8.5 The Affiliate may terminate participation in the program at any time by notifying AboutHelmets.com in writing or by email.

8.6 After the initial period of 12 months, the cooperation will be evaluated and may be renewed.

Article 9: Changes

9.1 AboutHelmets.com reserves the right to change these terms at any time. Changes will be announced at least 30 days prior to the effective date by email or via the website.

Article 10: Governing Law

10.1 These terms are governed by Dutch law.

10.2 Any disputes will be submitted to the competent court in Amsterdam.
